The Assessment Memo will be broken into (2) parts:
Written Assignment #1 – Assessment Memo Part 1 (due Week 1). This consists of Topics #1 only. See Topics #1 below. You will also find Topics #2 and 3 but those can be completed later.
Written Assignment #6 – Assessment Memo Final (due Week 7). This single memo consists of Topic #1 with the improvements, if any, I have mentioned, and Topics #2 and #3. You will find all 3 topics to be contained in the memo below. I will only accept ONE MEMO with all topics for Written Assignment #6. I DO NOT WANT 3 MEMOS with one topic per memo. Put all the topics in one memo.
For Written Assignment #1 – Assessment Memo Part 1, you need to complete Topic 1 only (600 words minimum). You can complete Topics #2 and 3 the rest of the memo at a later date.
The Written Assignment #6 – Assessment Memo Final due in Week 7, will incorporate what you completed here for Written Assignment #1 AND making any corrections/improvements according to my comments AND completing Topic 2 and Topic 3.
Here are all three topics to be covered in the final assignment:
Topics #1 (Only these topics need to be completed for Written Assignment #1 due at the end of Week 1)
Describe the concept of federalism and how it operates in the federation known as the United States of America.
The powers (jobs, jurisdiction) of each of the types of government in the federation called the United States. I want specifics with examples. Also, notice all that information cannot be one paragraph because of the rule: one topic per paragraph. Hint: the powers (jobs) of the fed gov is not the same at the state and tribal govs. Here is another hint: explain to me what types of laws each jurisdiction can make and enforce. Many students think the federal government can make any law it wants but this is wrong. I want to make sure you know what types of laws the federal government can make (that is the job of the federal government) and enforce as compared to the types of laws the state and tribal governments (that is the job of the state and tribal government) can make and enforce.
FEDERAL COURT JURISDICTION: Explain and give an example of a case filed in a federal court. This case must involve a dispute involving federal law. Be sure to tell the reader the federal law involved in the case in addition to giving a brief overview of the facts. Be sure to include the source of your example.
STATE COURT JURISDICTION: Explain and give an example of a case involving only state law – that is a case that can ONLY be filed in a STATE court but could NEVER be filed in a federal court. Since most cases involving federal law can also be filed in a state court, your example cannot be a state case involving a federal law claim. Your example must involve ONLY STATE LAW claims.
I want to know that you know, what types of cases involve federal law and what types of cases involve only state law and are therefore banned from being heard in any federal court, including the US Supreme Court. Many students erroneously believe any case can be appealed to the US Supreme Court, this is incorrect. I want you to know what types of cases can never be appealed to the US Supreme Court. Those cases are: state law only cases, that is cases not containing federal claims.
I am not asking for a tribal court case example of tribal court jurisdiction because tribal court jurisdiction is more complicated than state court jurisdiction and is not covered in this class.
Topic #2 (Completed in full for Week 7 “Assessment Memo Final Week 7”)
Pick an era in U.S. history, OTHER THAN THE ONE GIVEN IN THE EXAMPLE HERE, and describe how social and cultural forces shaped the law. For example, U.S. society rejected slavery in the early years of the existence of the United States. This paper cannot be about slavery or laws preventing slavery. This is just an example.
How did the law change as a result of this social and cultural forces?
Remember, you cannot write on the example given here about slavery — you must choose another topic.
Topic #3 (Completed in full for Week 7 “Assessment Memo Final Week 7”) THIS CANNOT BE THE SAME TOPIC AS ABOVE – YOU MUST HAVE A DIFFERENT TOPIC.
Choose one of the following:
a. Describe a recent change in the law and explain how it came about, including examples of specific events and/or people/groups affected. You can pick US law or the law of any country – your choice.
b. Describe a change you believe is needed in the law. Explain why you think this change is needed and support your opinion with data and research. You can pick US law or the law of any country – your choice.
Again, Topics #2 and 3 are not due for Written Assignment #1 which is due in Week 1. These topics are due for Written Assignment #6 due in Week 7.
Assessment Memo Specifications
Completed Assessment Memo assignments should meet the following specifications:
1. Length:
Assessment Memo Part 1 must be a minimum of 600 words.
Assessment Memo Final must be a minimum of 1800 words. Notice that you should have the first 600 words completed from the above assignment.
Use 12-point font, 1” margins.
2. Research: You must do research and include your sources! Note: I do not accept PowerPoints or videos as sources, please use reputable, quality sources.
See link at the left, “Legal Research links” to help you.
Google and Google Scholar are also helpful. If you do not know how to access Google Scholar, google “Google Scholar”.
All sources must be cited using Chicago Manual footnotes only. See note below for more information on footnotes.
3. EXAMPLES. EXAMPLES. EXAMPLES. Examples are one of the best ways to explain and understand the law (and probably everything else :). Include examples in your memo.
4. Footnotes: You must use Chicago Manual style footnotes only. You do not need a “Works Cited” or “Bibliography” page, only footnotes.
If URL only is used in the footnote, up to 25% will be deducted from your grade.
If you use MLA or APA inline citations, up to 25% will be deducted from your grade.
You do not need a “Works Cited” or “Bibliography” page but if you have one, there is no deduction. I will not look at it.
If you use footers instead of footnotes, it is up to 25% off. If you do not know the difference, find out the difference. IT IS VERY IMPORTANT TO USE FOOTNOTES AND NOT FOOTERS.
If you do not know how to insert a footnote into a document, now is a good time to learn (In Word, it can be completed from the ribbon on the top) . You can also get instructions by Googling “How to insert a footnote in Word”. Also, instructions can be found in the Resources folder for the assignments.
5. Formatting: I am very picky about formatting. Your paper must look professional. I prefer single-spacing as this is most commonly used in the business world. When single spacing you MUST put a blank line between paragraphs. Indenting the first line is optional when single spacing but is preferable. I do accept double spacing as long as it is done properly – that is NO EXTRA SPACES BETWEEN PARAGRAPH AND THE FIRST LINE MUST BE INDENTED, either is acceptable. There will be a 25% deduction for failing to do this. Again, follow the formatting of the samples provided to you in the Resources folder.
6. Free Review! I will review your formatting, footnotes, and content if you send me your paper 24 hours before the due date. You do not have to send me the entire paper, I will review what you send me. I will not grade the paper, but I will let you know if the formatting and footnotes are acceptable. I will also review the content. If you send it later I cannot guarantee I will review it before the due time.
8. Writing Center: You are strongly encouraged to use the CMU Writing Center – it’s free!. Be sure to allow sufficient time for them to review your paper, provide feedback, and for you to incorporate their input into your paper.
9. Grades: Written Assignment #1 – Assessment Memo Part 1 will receive its own grade — it is not a draft. That grade will never change. If you want to maximize your grade send me your paper, or part of your paper, at least 24 hours before the due time and I will review it and give you feedback. I will not grade the paper but will give you feedback. Written Assignment #6 – Assessment Memo Final, which includes all three topics, will receive a separate grade and the entire paper will be graded – that is you should make improvements I suggest to you concerning Topic #1.
