Big Box Discount Shoppe (“Big Box”) asked Honest Law firm to represent them in a workers compensation case where their employee allegedly injured their back while at work. About two weeks later, Value Mart, a business competitor, informed Honest Law firm that they would like the law firm to represent them in a case where a customer allegedly slipped, fell, and suffered injury on some ice in the Value Mart parking lot. You are familiar with both businesses, because the stores are popular in your community. However, you shop at Big Box more since they offer better deals on the products that you like. In order to determine whether Honest Law firm can represent Big Box and Value Mart, Marilyn, your supervising attorney, asks you, the paralegal, to help him determine whether or not a conflict of interest exists. Before you begin your assignment, read ABA Model Rule 1.7 and its comments.
Based on your readings, write a memorandum using the template provided. In your memorandum, address the questions below. Be sure to discuss and apply the ABA Model Rule 1.7 in your analysis.
Discuss whether it would be a conflict of interest to represent Big Box and Value Mart if they are business competitors.
Discuss whether it would be a conflict of interest to represent Big Box and Value Mart if you, the paralegal, prefer to shop at Big Box more than at Value Mart
Discuss whether it would be a conflict of interest to represent Big Box and Value Mart if the law firm advocates inconsistent positions for each of the clients.
